Service Offer Agreement of JOYFUL

PUBLIC OFFER AGREEMENT

This Public Offer Agreement (“Agreement”) is an official offer made by JOYFUL (“Company”, “we”, “us”), a company registered in Brazil, represented by its Director Nursultan Toktosunov, to enter into a service agreement under the terms set out below.

By accessing or using the website https://wishjoyful.com and/or making any payment, the user (“User”, “Customer”) fully and unconditionally accepts this Agreement.


1. General Provisions

1.1. This Agreement governs the relationship between the Company and any individual (“User”) using the website wishjoyful.com.

1.2. The Company provides digital, non-physical online services only.

1.3. No physical goods are sold or shipped.


2. Subject of the Agreement

2.1. The Company provides Users with access to digital services, including but not limited to:

  • wishlist creation and management tools;
  • platform functionality for digital content;
  • user account features.

2.2. Services are considered delivered once access to the platform functionality is granted.


3. Acceptance of the Agreement

3.1. Acceptance of this Agreement occurs when the User:

  • registers an account on the website;
  • uses the platform services;
  • completes a payment.

3.2. By accepting this Agreement, the User confirms that:

  • they have read and understood the terms;
  • they agree to be legally bound by them.

4. Pricing and Payments

4.1. Prices for Services are displayed on the website prior to payment.

4.2. All payments are processed by the payment provider Stripe.

4.3. The Company does not store or process any credit/debit card information.

4.4. Bank statements may show the transaction as JOYFUL / WISHJOYFUL.


5. Refunds and Cancellations

5.1. Due to the nature of digital services, all payments are generally final and non-refundable.

5.2. Refunds may be issued only in the following cases:

  • duplicate payment;
  • technical error caused by the platform;
  • failure to deliver the purchased service.

5.3. Refund requests must be submitted within 7 calendar days from the payment date to:
support@wishjoyful.com


6. Rights and Obligations

6.1. Company Obligations:

  • provide access to the Services as described;
  • ensure reasonable data security measures;
  • comply with applicable data protection laws.

6.2. User Obligations:

  • provide accurate information;
  • use the Services lawfully;
  • not abuse refund or chargeback mechanisms;
  • not interfere with platform or payment systems.

7. Limitation of Liability

7.1. The Services are provided on an “as is” and “as available” basis.

7.2. The Company shall not be liable for:

  • service interruptions;
  • indirect or consequential damages;
  • actions of third parties.

8. Personal Data

8.1. Personal data is processed in accordance with the Company’s Privacy Policy, available on the website.

8.2. By using the Services, the User consents to such processing.


9. Prohibited Use

Users are strictly prohibited from:

  • using the Services for illegal or fraudulent purposes;
  • interfering with payment systems or platform security;
  • violating applicable laws or regulations.

10. Governing Law and Dispute Resolution

10.1. This Agreement is governed by applicable international commercial law principles, together with mandatory consumer protection laws of the User’s jurisdiction where applicable.

10.2. Parties shall first attempt to resolve disputes amicably. If not possible, disputes shall be resolved under applicable law.

12. Final Provisions

12.1. The Company reserves the right to update this Agreement at any time.
